WHAT TO DO AT AN ICE CHECKPOINT, ESPECIALLY IF YOU’RE A WHITE CITIZEN
(please, please, please copy, paste, and share widely):
-Border Patrol can verify citizenship within 100 miles of a border or “external boundary.” This includes coastlines so NYC is within the 100-mile zone.
-Border patrol can only ask brief questions about citizenship, and they cannot hold you for an extended time without cause.
-You always have the right to remain silent. You do not need to answer their questions.
-***WITH THAT SAID, IF YOU ARE A BORN CITIZEN OF THE UNITED STATES AND ESPECIALLY IF YOU ARE WHITE, YOU NEED TO SPEAK THE FUCK UP.***
-The most important acts of resistance are the small ones. Make it difficult and uncomfortable for ICE agents to do their jobs. They are counting on citizens to turn a blind eye and allow them to deport undocumented citizens without challenge. Disabuse of that notion.
-If you are on a train, bus, or anything else and ICE or CBP boards, you need to stand up and loudly let everyone know that they have the right to remain silent or only answer questions in the presence of an attorney, no matter their citizenship or immigration status. There have been numerous reports that confronting the agents in this way has caused them to leave without verifying citizenship. THIS CAN SAVE LIVES.
-If you see anyone being held up by immigration, loudly ask if they are being detained and if they are free to go.
-Immigration officers cannot detain anyone without reasonable suspicion, an agent must have specific facts about you that make it reasonable to believe you are committing or committed, a violation of immigration law or federal law.
If an agent detains you, you can ask for their basis for reasonable suspicion, and they should tell you.
-Always say no to a search and let everyone know that they can and should refuse consent to a search.
-They cannot search or arrest anyone without facts about that make it probable that they are committing, or committed, a violation of immigration law or federal law.
-Silence alone meets neither of these standards. Nor does race or ethnicity alone suffice for either probable cause or reasonable suspicion
-As white citizens, we have a level of privilege which protects us from retaliation from ICE for being “rude” and making a scene, which makes it our DUTY to speak up and make sure people without the same privilege know their rights. GET LOUD. YELL. YELL IN SPANISH IF YOU KNOW IT. LET PEOPLE KNOW THEY DON’T HAVE TO SAY SHIT. MAKE ICE UNCOMFORTABLE. THROW SAND IN THE GEARS OF WHITE SUPREMACY.
BONUS INFO:
-It is perfectly legal to record immigration agents as long as you are not on government property or at a port of entry. If your train/bus gets board, pull your phone out and start videotaping immediately.
-If you are detained or see someone getting detained, get the agent’s name, number, and any other identifying information. Get it on tape.
-Contact the ACLU if you see someone’s rights being violated.
Half of these comments are arguing (in fewer words) that property destruction is not a legitimate form of protest. The other half are arguing over if its actually a pikachu or a mimikyu
They were actually in the building. They were doing a sit-in in the atrium. The charge was under this part of the DC code.
Penalty is up to a $500 fine or 90 days in jail if they are formally prosecuted. At least one Representative was arrested. Also, be more specific, it appears all of the protestors were women.
And although they were arrested, they got the cheers from the office workers, not the cops.
There isn’t a fundraiser to help pay fines yet.
Basically, keep it up for those of us who can’t risk arrest for whatever reason (health, disability, young children, sole breadwinner, etc).
One of the more fascinating and horrible details in Reuters’ thoroughly fascinating and horrible long-form report
on Trump’s cruel border policies is this nugget: ICE hacked the
risk-assessment tool it used to decide whom to imprison so that it
recommended that everyone should be detained.
This gave ICE a kind of empirical facewash for its racist and inhumane
policies: they could claim that the computer forced them to imprison
people by identifying them as high-risk. The policy let ICE triple its
detention rate, imprisoning 43,000 people.
To conform to Trump’s policies, Reuters has learned, ICE modified a tool officers have been using since 2013 when deciding whether an immigrant should be detained or released on bond. The computer-based Risk Classification Assessment uses statistics to determine an immigrant’s flight risk and danger to society.
Previously, the tool automatically recommended either “detain” or “release.” Last year, ICE spokesman Bourke said, the agency removed the “release” recommendation, but he noted that ICE personnel can override it.
Of course, said ICE personnel would have to a) know that the option has been removed entirely, not just that the software isn’t recommending it in that particular case, and b) actually be a decent enough of a human being to give a shit and override it.
That orange assh*ole is always doing something evil to distract from something even more evil!
The plight of those immigrant children is emphatically not a distraction or a less significant evil. Dragging children from the arms of their parents and putting them in concentration camps is a crime against humanity, is what it is.
The Trump administration wants both. They want ethnic cleansing and destruction of the social safety net. Neither is acceptable. Defend immigrants and the poor, disabled, and elderly.
Do not fall for the lie that you have to pick one or the other.
If you’re horrified by news of families being separated at the borders, here’s a bit of news you can use.
First, the policy: It helps to be incredibly clear on what the law is, and what has and has not changed. When Donald Trump and Sarah Huckabee Sanders say that the policy of separating children from their parents upon entry is a law passed by Democrats that Democrats will not fix, they are lying.
There are two different policies in play, and both are new.
First is the new policy that any migrant family entering the U.S. without a border inspection will be prosecuted for this minor misdemeanor. The parents get incarcerated and that leaves children to be warehoused. The parents then typically plead guilty to the misdemeanor and are given a sentence of the few days they served waiting for trial. But then when the parents try to reunite with their children, they are given the runaround—and possibly even deported, alone. The children are left in HHS custody, often without family.
Second is a new and apparently unwritten policy that even when the family presents themselves at a border-entry location, seeking asylum—that is, even when the family is complying in all respects with immigration law—the government is snatching the children away from their parents. Here, the government’s excuse seems to be that they want to keep the parents in jail-like immigration detention for a long time, while their asylum cases are adjudicated. The long-standing civil rights case known as Flores dictates that they aren’t allowed to keep kids in that kind of detention, so the Trump administration says they have to break up the families. They do not have to break up families—it is the government’s new choice to jail people with credible asylum claims who haven’t violated any laws that is leading to the heartbreaking separations you’ve been reading about.

Update, June 17, 2018: Thanks to readers who updated us with more organizations fighting this policy. Other good work is being done by the following:
• CLINIC’s Defending Vulnerable Populations project offers case assistance to hundreds of smaller organizations all over the country that do direct services for migrant families and children.
• The Michigan Immigrant Rights Center represents all of the immigrant kids placed by the government in foster care in Michigan (one of the biggest foster care placement states). About two-thirds are their current clients are separation cases, and they work to find parents and figure out next steps.
• The Northwest Immigrant Rights Project is doing work defending and advancing the rights of immigrants through direct legal services, systemic advocacy, and community education.
• The Women’s Refugee Commission has aggregated five actions everyone can take that go beyond donating funds.
• And finally, the International Refugee Assistance Project (IRAP)—which organizes law students and lawyers to develop and enforce a set of legal and human rights for refugees and displaced persons—just filed suit challenging the cancellation of the Central American Minors program.
Update, June 18, 2018, 8:19 p.m.: Listed below are more organizations that are helping separated families at the border. Thanks again to readers who sent in information:
• Houston Immigration Legal Services Collaborative has a guide to organizations throughout Texas that provide direct legal services to separated children. Also listed within the guide are resources for local advocates, lawyers, and volunteers.
• Immigrant Justice Corps is the nation’s only fellowship program dedicated to expanding access to immigration representation. Some IJC fellows work at the border, and others work in New York, providing direct representation in immigration court to parents and children resettled in New York City and surrounding counties.
• The Kino Border Initiative provides humanitarian aid to refugees and migrants on both sides of the border. They have a wish-list of supplies they can use to help migrants and families staying in the communities they serve.
Several companies also match donations—if your company does this, you need to provide the tax ID of the charity you have given to, which is usually listed on these organizations’ websites.
